1.2 Location Information

We collect location information to provide our delivery services:

• For Customers: We collect your specified delivery address and may access your device's location (with your permission) to help you select delivery locations more easily
• For Delivery Partners: We collect precise, real-time location data to enable order tracking, route optimization, and delivery confirmation. This location data is collected continuously while you are actively using the app for deliveries

1.3 Device and Usage Information

We automatically collect certain information about your device and how you interact with our app:

• Device information (device type, operating system, unique device identifiers)
• App usage data (features used, time spent, pages viewed)
• Log information (IP address, access times, app crashes)
• Push notification tokens for sending you notifications

1.4 Camera and Photo Library

With your permission, we may access your device's camera and photo library to allow you to upload profile pictures or images related to orders.

2. How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve our delivery services
• Process and fulfill your orders
• Facilitate communication between customers, delivery partners, and merchants
• Send you order confirmations, delivery updates, and notifications

3. How We Share Your Information

• With Delivery Partners: We share your delivery address, contact information, and order details with delivery partners assigned to fulfill your order
• With Merchants: We share order information with merchants to process and prepare your orders

  • Google Maps for location and mapping services
  • Payment processors

1. Introduction

Welcome to DIBO! These Terms of Service ("Terms") outline the rules and regulations for the use of our mobile application and delivery service, located in Tripoli, Lebanon. By accessing or using DIBO, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Acceptance of Terms

By creating an account, accessing, or using the DIBO application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and DIBO.

3. Description of Service

DIBO is a delivery platform that connects customers with delivery partners and merchants. We facilitate the ordering and delivery of food and other items. DIBO acts as an intermediary platform and is not responsible for the quality, safety, or condition of items delivered by merchants or delivery partners.

4. User Accounts

4.1 Account Creation

To use certain features of our service, you must create an account. When creating an account, you must:

• Provide accurate, complete, and current information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years old

4.2 Account Responsibility

You are responsible for all activities that occur under your account. Failure to comply with these requirements may result in immediate termination of your account.

5. Orders and Payments

5.1 Order Placement

All orders are subject to:

• Product availability and merchant confirmation
• Confirmation of the order price (prices may change)
• Acceptance by the merchant

5.2 Payment Terms

Payment must be made at the time of order placement or upon delivery as specified in the app. We accept:

• Cash on delivery
• Other payment methods as indicated in the app

All prices are displayed in the currency specified in the app and are subject to applicable taxes and delivery fees.

5.3 Refunds and Cancellations

Refund and cancellation policies vary by merchant and order type. You may cancel an order before it is confirmed by the merchant. Once an order is confirmed and being prepared, cancellation may be subject to merchant policies and fees.

6. Delivery Service

6.1 Delivery Times

Delivery times are estimates and may vary according to:

• Product availability
• Distance and traffic conditions
• Weather conditions
• Force majeure events

We are not responsible for delays resulting from circumstances beyond our reasonable control.

6.2 Delivery Areas

Our delivery services are currently available in Tripoli, Lebanon, from 8:00 AM to 10:00 PM, seven days a week. Delivery availability may vary by location and time.

6.3 Delivery Partners

Delivery partners are independent contractors, not employees of DIBO. We are not responsible for the actions, conduct, or performance of delivery partners.

7. User Conduct

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any part of the service
• Transmit any harmful code, viruses, or malicious software
• Impersonate any person or entity
• Harass, abuse, or harm other users, delivery partners, or merchants
• Use automated systems to access the service without permission
• Collect or harvest information about other users

8. Intellectual Property

The DIBO application, including its design, features, content, and functionality, is owned by DIBO and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without our express written permission.

9. Liability and Limitation of Liability

9.1 Service as Intermediary

DIBO acts as an intermediary platform connecting customers, merchants, and delivery partners. We are not responsible for:

• The quality, safety, freshness, or condition of items delivered
• The accuracy of menu items, descriptions, or prices provided by merchants
• The conduct or performance of merchants or delivery partners
• Any disputes between customers and merchants or delivery partners

9.2 Limitation of Liability

To the maximum extent permitted by law, DIBO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the service.

Our total liability for any claims arising from your use of the service shall not exceed the value of the delivery fee paid for the specific order in question.

9.3 Indemnification

You agree to indemnify and hold harmless DIBO, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, violation of these Terms, or infringement of any rights of another party.

10. Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the service at any time
• Change features, functionality, or availability
• Update or modify these Terms

We will provide reasonable notice of material changes when possible. Continued use of the service after changes constitutes acceptance of the modified Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent, illegal, or harmful activities
• You provide false or inaccurate information
• We are required to do so by law

12. Dispute Resolution

If you have a dispute with a merchant or delivery partner, we encourage you to contact us first. We will attempt to facilitate resolution but are not obligated to resolve disputes between users and third parties.

For disputes with DIBO, you agree to first contact us to attempt to resolve the dispute. If we cannot resolve the dispute, it shall be governed by the laws of Lebanon and subject to the exclusive jurisdiction of the courts of Tripoli, Lebanon.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Lebanon, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DIBO regarding the use of our service and supersede all prior agreements and understandings.
